Details
The new Free Trade Agreements, and the Implementation
Acts, per the above, now allow citizens and nationals of Chile and Singapore to
obtain the new H-1B1 Visa, allowing them to come to the United States to
perform services on a temporary basis in a specialty occupation as defined in
Subsection 3 of the Immigration and Nationality Act, Section 214 (i), meaning
an occupation requiring the theoretical and practical application of a body of
specialized knowledge and the attainment of at least a bachelors or higher degree
in the specialty, or its equivalent, as a minimum for entry into the occupation
in the USA.
These Visas are temporary visas, subject to renewal and
extension, as business requires, on a yearly basis, with no limitation.
However, after two such extensions, a new Labor Attestation Certification, per
below, will be required.
These Visas do not require a petition to the
immigration office of the United States government, however they do require
obtainment of a Labor Attestation Certification from the U. S. Department of
Labor before the overseas office of the U. S. Department of State can issue the
visa.
An employer / sponsor is required in order to apply for an
H-1B1 Visa.
1,400 H-1B1 Visas are available to Chileans and 5,400
H-1B1 Visas are available, per year, to Singaporeans.
NEW E VISAS FOR
CHILEAN AND SINGAPOREANS.
Also, in the same Agreement and legislation that created
the H-1B1 Visa, both Chileans and Singaporeans are also allowed to obtain, upon
a proper showing, E Visas as either Treaty Traders or Treaty Investors.
These E Visas are temporary Visas, subject to multiple
renewals, as business requires.
E-1 Visas are provided to Treaty Traders to manage
bi-lateral trade.
E-2 Visas are provided to Treaty Investors to manage and
direct their respective investment in the U.S.A.
